Version 2026-10 v13 (for legal review)

Who we are

Jeremy Formosa trading as No Quit Coaching (ABN 96 167 283 503), Glebe NSW ("NQC", "we"). We provide personal training, online coaching, fitness challenges and the NQC app. Because we collect health information to provide a health service, we are covered by the Privacy Act 1988 (Cth), including the Australian Privacy Principles, and the Health Records and Information Privacy Act 2002 (NSW). Contact: jeremy@noquitcoaching.com.au or 0410 674 656.

What we collect

Identity and contact details: name, email, mobile, date of birth, emergency contact and, for under-18s, a parent or guardian's details.

If you're under 18: your parent or guardian's full name, relationship to you, mobile and (if you give it) email. We send them a link by SMS and email so they can read your agreement, the risk warning and your health check answers, and sign it on their own phone with a code we text them. We record their name, relationship, mobile, when they signed, that the code was checked, and the internet address and browser of the device they signed on. The link and code are stored only in a form that can't be read back.

Health information: your pre-exercise health check (each time you answer it, with your notes and any declaration that a health professional has cleared you to exercise), injuries and limitations, height, weight, body measurements, progress photos, daily and weekly check-ins (sleep, stress, energy and similar), training logs and nutrition logs, supplements you choose to track and your answers to the supplement safety check.

Wearable data, only if you connect a fitness tracker (such as Oura or WHOOP) and give the separate wearable consent: sleep (time asleep, time in bed, sleep stages, efficiency, bedtime), heart rate variability, resting and overnight heart rate, breathing rate, blood oxygen, skin temperature or its change from your normal, steps, active calories, activity and workouts, and the device's own readiness, recovery, strain or stress scores. If you use the NQC iPhone or Android app, you can connect Apple Health or Health Connect instead of (or as well as) a wearable. We read only the types you allow on your phone (sleep, heart rate variability, resting heart rate, breathing rate, blood oxygen, steps, active calories and workouts), for the last 30 days when you connect and then each time you open the app. NQC never writes to Apple Health or Health Connect. To stop it completely, turn NQC off in your phone's Health app or Health Connect settings as well as disconnecting in the app. We fetch up to the last 6 weeks when you connect, then each day while connected.

Coaching content: your program, targets, messages with your coach, and your Ask NQC (AI) chats, including any photos you send in the chat. AI Tracker food photos aren't kept (see Who sees it).

Payments: your membership, bookings and payment history. Card and bank details are collected and held by our payment provider, Stripe, not by us.

App usage: device and log information needed to run the app securely, including a random device identifier the app stores in your browser (a cookie). It identifies nothing about you; we use it so a parent or guardian's signing link can't be signed on the phone their child signed up on.

Copies on your phone (offline mode): so the app works without internet, it keeps copies on your phone of the screens you've opened (for example your program, workouts, food log and check-ins) and of anything you log while offline, until it has synced to your account. They stay on your phone only, and are cleared when you log out. If you log out before something has synced, the app warns you first.

How and why we use it

We collect it from you, from your coach's notes, from our payment provider and, for under-18s, from your parent or guardian. We use it to train and coach you safely, set and adjust your program and nutrition targets, run bookings and memberships, take payments, send you service messages (like booking reminders and payment notices), run Ask NQC, keep the app secure and meet our legal obligations.

If you connect a wearable we use its data, together with your training and nutrition logs, to work out a daily health score and suggestions (push, train as planned, go lighter or rest; and flags for short sleep or a suggested deload week). The score is worked out by fixed rules, not AI, and wearable data is never sent to our AI provider. Your coach can see the score and the numbers behind it. The score only makes a suggestion: it never changes your program or membership. We never use wearable data for advertising and never sell it. You can disconnect at any time in More → Connect Wearable, which also withdraws NQC's access at Oura or WHOOP. If you tap "Delete all my wearable data", it's deleted from the App straight away and fully deleted within 72 hours, including from backups we control as they roll over. This applies to wearable data only; other health records may have to be kept for a period after your last service (see below).

We collect health information only with your consent, which you give at sign-up. If you don't provide it, we can't safely train you.

We keep safety records: every health check you answer (we ask again every 12 months and after you report a health issue), your Coach's follow-up of your health check, baseline assessments, equipment instruction, any warning signs you report before training, and any Ask NQC message flagged for your Coach's attention (for example, language that may point to a difficult relationship with food). These help us keep you safe.

We only send you marketing (news, challenges and offers) if you opt in. Every marketing email and SMS has a way to unsubscribe, and you can turn off News and offers at any time in More → Consents. We'll stop sending you marketing after you do. Service messages (bookings, payments, cancellations) never contain offers, and never contain health details: they link into the app instead.

We only use your check-in or progress photos in marketing if you're 18 or over and have given the separate Marketing Photos consent, with your choice of face shown or hidden. You can withdraw it at any time; we stop new use and take your photos down from NQC's own pages and accounts within 14 days.

We don't use advertising or tracking pixels (such as Meta or Google) inside the app or on any page where you give us health information.

We never sell your information.

Who sees it

Your coach and other NQC staff who need it to coach you or run the business. Coaches and NQC staff can read your messages and your Ask NQC chats. Progress photos: only you, your coach and NQC staff who support you, unless you give the separate Marketing Photos consent.

Service providers who process it for us, and where: Supabase (our database and file storage, hosted in Sydney, Australia; its support staff may access it from overseas); Vercel (app hosting, United States and its global network); Stripe (payments, United States and other countries); GoHighLevel (SMS and email, United States); Anthropic (our AI provider for Ask NQC, the AI Tracker, program uploads and the AI Check-In, United States); OpenAI (our second AI provider, for photos you upload to make a custom avatar only, United States: we don't keep the photo, and OpenAI may keep it for up to 30 days to check for misuse, then deletes it; it isn't used to train their AI); and, if you connect one, your wearable's maker (for example Oura or WHOOP), which sends us your data under its own privacy policy. Apple and Google, if you turn on phone notifications: the notice's title and which screen it opens go through Apple's or Google's notification service to reach your phone. Notifications never include health details. We choose providers with strong security and contractual privacy protections, and we remain responsible for how they handle your information.

For Ask NQC, these are sent to Anthropic in the United States to generate a reply: what you type and any photo you send, and the information Ask NQC needs from your account: your first name, age, sex and height; your goals and training and food preferences; your injuries; which health check questions you answered yes to; your weigh-ins; today's Nutrition Tracker log; your Macro Framework (calorie and macro targets), program, recent workouts and Food Framework (meal plan); and your latest weekly check-in (scores, weight, anything you wrote about your week, and your coach's reply to it). Your health check notes, wearable data and progress photos are never sent. If your coach imports a program from a file or photo, that file is also sent to Anthropic to read it. Please don't put information in Ask NQC that you don't want processed this way.

AI Tracker (Nutrition Tracker → Add Food): the food photo you take (with any location data in it removed first) and what you type about the meal are sent to Anthropic in the United States only to work out the estimate. We don't keep the photo: it's never saved to our database, file storage or logs, and it's deleted straight after the estimate. The foods and amounts you choose to add go in your Nutrition Tracker, marked as an AI estimate. If you upload a program you follow, those photos, screenshots or PDF are also sent to Anthropic to read it and aren't kept.

AI Check-In (App Members, only when you ask for it): a summary of your last 4 weeks is sent to Anthropic in the United States to write the check-in: your first name, age, sex and height; your goals and weight goal; your Macro Framework targets and the body fat on your profile; your weekly check-in body weight and measurements, with a body fat estimate the app works out from them (the US Navy tape formula); how many days you tracked food and your average calories, protein and fibre on those days; your weigh-ins; your workouts done and the top sets of your main lifts; what you entered in your daily check-ins (sleep hours, steps, water, whether you stuck to your diet); and your weekly check-in scores and what you wrote about your wins and struggles. If you've turned on "Let the AI Check-In use my progress photos" (More → Consents), your progress photos from those 4 weekly check-ins are also sent (made smaller, with location and other details removed) for that check-in only: Anthropic doesn't keep them, and we don't store them again with the result. Without that switch the AI Check-In can't run. Your health check answers and notes and wearable data are never sent. The check-in and the summary it was written from (not the photos) are kept on your account so you and NQC staff can see them. If you save its body fat estimate to your profile, your body fat and protein target are updated.

AI charges: we record each time you use an AI feature (when, which feature, how much text the AI read and wrote, and what it cost) so we can charge you what it cost us. That record is kept with your payment records.

We may also disclose information where the law requires or allows it, for example in a medical emergency.

AI and automated decisions

Ask NQC uses AI to answer questions and draft programs and Food Frameworks (meal plans). For PT Clients and Online Coaching Clients, it can't change your coach's plan; it can only send your coach a request.

Ask NQC is set up to decline some requests (for example calorie targets for under-18s or when your health check flags a condition, very low intakes, supplements, or dangerous substances) and refer you to a health professional, and to limit any weight-loss plan to no more than 1% of your body weight a week. It can make mistakes.

These decisions are made automatically by the app, using your personal information:

• App lock for non-payment (fully automatic): when a payment is still unpaid 48 hours after it failed, the app locks to the update-payment screen, and unlocks once the payment goes through. Uses your payment status.

• Late cancellations and Session Credits (fully automatic): a Session cancelled less than 24 hours before it starts, or not turned up to, is forfeited; one cancelled 24 hours or more ahead goes back on your PT Bundle or becomes NQC Credit, or on a Weekly PT Membership you choose another time that week, a Session Credit or its price off your next payment. Uses your bookings, plan and the time you cancelled. You can ask your coach to review one.

• App Membership billing (fully automatic): charged every 4 weeks in advance until you cancel; a Prepaid PT Bundle moves to an App Membership 4 weeks after your last Session if you haven't bought more or booked any. Uses your plan, bookings and payment history.

• AI charges (fully automatic): each AI use you start is priced at what it cost us, capped per use, added up each month and charged with your normal payment (or straight away once it reaches $12.50 in a month); AI features pause if an AI charge doesn't go through. Uses your AI use records, plan and payment status.

• Health check gates (fully automatic): a yes to one of the first five health check questions, without a declaration that a health professional has cleared you, blocks the app from building or giving you a new program, and the health check is asked again every 12 months and after you report a health issue. Uses your health check answers and safety reports. Your coach can't override it; you can update your answers at any time.

• Programs and Food Frameworks for App Members (fully automatic): built by the app's rules and Ask NQC from your answers, and go live without a coach reviewing them. Uses your profile, health check answers, injuries, goals and preferences. For PT and Online Coaching Clients, programs assist your coach, who approves them; a Food Framework goes live without your coach approving it only if it fits the Macro Framework your coach set (your coach can see it), and your Macro Framework only changes with your coach.

• Daily health score (assists you and your coach): worked out from your wearable data and training and nutrition logs. It's general guidance, not a medical assessment, and it never changes your program by itself.

You can contact us about any automated decision and ask a person to look at it.

Keeping it safe and how long we keep it

Your information is stored in Sydney, protected by access controls so clients only see their own information and coaches only see their own organisation's clients. Progress photos are stored privately and shown only through short-lived links. We keep a record of each time a coach or NQC staff member views your progress photos, and you can see it in the app (More → Consents). If you remove a progress photo in the app, or withdraw the Progress photos consent, the photo (or all your progress photos) is deleted straight away, including the stored file, and can't be recovered. We keep a record that it was deleted.

We keep health records for 7 years after your last service, or until you turn 25 if you were under 18, as NSW law requires. If you close your account we stop using your information and delete what we can; we keep the health records for that period and then delete them.

We have a written data breach response plan. If we suspect a breach we assess it within 30 days (much sooner where we can), and if it is likely to cause you serious harm we tell you and the Office of the Australian Information Commissioner as soon as practicable.

Accessing and correcting your information

You can see most of your information in the app, including your signed agreements and consents, and download a copy of your information at any time under More → Download My Data (it lists everything it includes; photo files are listed by name. Email us for copies of the photos, or for your coach's private working notes about you). It's free. You can also ask us for a copy, or to correct anything, including while your account is paused. We'll respond within 30 days.

You can change your optional consents (progress photo storage, letting the AI Check-In use your progress photos, news and offers, Marketing Photos) at any time in the app under More → Consents. We keep a record of every change.

Complaints

Contact us first at jeremy@noquitcoaching.com.au or on 0410 674 656. We'll respond within 30 days. If you're not satisfied, you can complain to the Office of the Australian Information Commissioner (oaic.gov.au) or, for health information, the NSW Information and Privacy Commission (ipc.nsw.gov.au).

Changes

We'll update this policy when our practices change and show the date of the latest version. Significant changes will be notified in the app.
